Terms of Service

1. The Service

Docaira is a document collection platform enabling landlords and property managers ("you", "User") to request, collect, and manage documents from tenants. Docaira is operated by its founder, based in Sweden ("Docaira", "we").

By creating an account you agree to these Terms in full. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and acting in a professional or business capacity as a landlord or property manager to use Docaira. The service is not intended for personal consumer use.

3. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share account access with others. Notify us immediately at team@docaira.com if you suspect unauthorised access.

4. Subscriptions and Billing

  • Plans are billed monthly or annually as selected at checkout.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • You may cancel at any time via the Billing page; access continues until the end of the paid period.
  • We do not offer refunds for partial subscription periods.
  • Prices are shown in EUR and may exclude VAT where applicable.
  • We reserve the right to change prices with 30 days' notice by email.
  • Free trial accounts are limited to 3 cases. The trial period is 14 days.

5. Acceptable Use

You agree not to:

  • Use Docaira to collect documents without a lawful legal basis under applicable tenancy or data protection law
  • Upload or transmit malicious files, malware, or illegal content
  • Attempt to access other users' accounts or data
  • Use the platform for any purpose other than legitimate property management
  • Resell, sublicense, or otherwise commercialise access to the platform
  • Conduct automated scraping, probing, or load testing without prior written consent

6. Landlord Responsibilities

You are the data controller for all tenant personal data processed through your Docaira account. You are solely responsible for:

  • Ensuring you have a lawful legal basis (e.g. pre-contractual necessity or legitimate interest under tenancy law) to request the documents you specify
  • Informing tenants of your data processing activities before sending them a Docaira link
  • Responding to tenant data subject rights requests
  • Complying with applicable tenancy and data protection laws in your jurisdiction

Docaira processes tenant data as your data processor under the Data Processing Agreement accepted at registration.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We will endeavour to notify you of planned maintenance in advance. Temporary outages do not entitle you to a refund.

8. Intellectual Property

Docaira and its underlying software are owned by the operator of Docaira. Your case configurations, uploaded tenant documents, and account data belong to you. We claim no ownership rights over your data. You grant us a limited licence to process your data solely for the purpose of delivering the service.

9. Disclaimers

The service is provided "as is" without warranty of any kind. We do not warrant that the service will meet your specific requirements or be error-free. We are not responsible for the legal validity of any tenancy arrangement or the accuracy of AI-generated communications with tenants.

10. Limitation of Liability

To the maximum extent permitted by Swedish law, our total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the greater of: (a) fees paid by you in the 12 months preceding the claim, or (b) EUR 500.

We are not liable for indirect, incidental, consequential, special, or exemplary damages including lost profits, loss of data, or loss of business.

11. Termination

You may close your account at any time via the Settings page. We may suspend or terminate your account for material breach of these Terms with 7 days' written notice, or immediately for serious breaches (fraud, illegal use, abuse of the platform). Upon termination, your data will be handled as described in the Privacy Policy and DPA.

12. Governing Law and Disputes

These Terms are governed by the laws of Sweden. Any dispute arising out of or in connection with these Terms shall be submitted to Stockholm District Court (Stockholms tingsrätt) as court of first instance, unless mandatory consumer protection laws require otherwise.

13. Changes to These Terms

We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
